    A debt collector
    A debt collector called my mother about back taxes that she could not pay because she was in the HOSPITAL. They also called the neighbors and her job. Finaly they made threats of jail time. I counted 37 different violations of federal law in their messages and phone calls. Imagine their surprise when the debt was paid with their money given to us when we destroyed them via a quick and just lawsuit. Protect yourselves. If they threaten you once, they can be sued.

    (continued)if a collector calls set up a pmnt arangment w/check by phone it will stop the calls & u will pay what is owed, If you feel the debt is not owed you MUST notify us in WRITTING w/in the first 30 days u receive the notice it is our job to collect legitamate debt
    that is owed to our clients As bad as the economy is can you imagine what it would be like if we all didn’t pay our bills & nothing was done to atleast attempt to have them paid? Business would not exsist.

    I am a professional collector I work for IC system, We are required not only to pass the FDCPA GLBA & state laws when we are hired we must get 100% twice a year we know them very well. Also I can see why collectors have a bad rep b.c years ago there were not laws and the practices were done terribly. its a new time and not ever do we intend to embaress or harass, but b/c of the rep we have as soon as a debtor answers they ume the worst and immediatly yell ect…

    debt collectors are brilliant. they use geurilla tactics and pure aggrevation to get YOUR money back. they take a percentage, but they get you your money. if you ever owe money you will see this and use debt collectors. i guarantee it.

    You should hope they do this most good law firms will take your case pro bono. not only will you be awarded damages in a civil suit, but the fed govmt takes action against them as well. Resulting in a another check cut to you for their illegal practices. You Can literally no joke turn your debt into profit. If they did their jobs right then might collect whats owed to them. What’s funny is that one part when the guy says ohhh how embaressing it must be that a MESSAGE just a MESSAGE (a name and a phone number) was left with a neighbor…. but the whole time I’m thinking, YA KNOW IF THEY HAD PAID JUST $20 A MONTH AND PICKED UP THE PHONE AND DIDNT RUN LIKE A , NO MESSAGES WOULD BE LEFT WITH NEIGHBORS!!!!!!!! TO TAKE AND NOT PAY FOR WHATEVER REASON ISN’T HONORABLE AND SHOULDN’T GO UN-PUNISHED!!!!

    the FDCPA was passed to protect those who DO OWE the money.

    You cannot subvert the FDCPA with the “well he owes the money” defense, You will get spanked by a man in a black dress for that defense faster than a debt collector can run a credit card transaction.

    Yes they can call to obtain location information …. only ONCE.

    caveats…

    they can call again if they have a “reasonable’ belief that information previously given was inaccurate and you now have accurate information… good luck proving that “reasonable” belief.

    They better not be in possession of accurate location information when they make the one call allowed.

    They better not reveal that the consumer owes a debt.

    They better not use ‘pretexting” to obtain information.

    If they violate federal law the donsumer is entitled to damages. Attorney’s fees, Actual damages and Statutory damages.

    a request for waiver of summons is sent by certified mail. If you choose not to send that or they fail to excecute it then YES they are served a summons by US Marshals.

    As for damaged. Merely calling me in re to the debt IS a violation of Federal law if:

    I have refused to pay the debt.
    I have disputed the debt and they have failed to provide verification.
    I have told them that calls are incovenient.

    get your point and it’s funny but US Marshalls dont serve civil complaints. it’s done via certified mail. You also have to have incurred damages. calling you in re to your debt is not causing damages.
